Join us January 1 starting at 7am and witness history as we #TurnANewLeaf! With all the new cannabis rules and regulations there’s a lot of information to process, so we put together this list of Frequently Asked Questions to help prepare you for what to expect in 2018.

  1. Who can purchase cannabis?

As of Jan. 1, 2018 – Anyone 21+ with a valid government issued, picture I.D. can legally purchase cannabis.

  1. How will cannabis be taxed?

Recreational “Adult-Use” Marijuana sales will be charged 15% state excise tax, 7.75% sales tax, and 5% municipal tax. Medical Marijuana patients with a MMIC card will be charged 15% state excise tax, and Medical Marijuana patients with a doctor’s recommendation will be charged 15% state excise tax and 7.75% sales tax.

  1. What are the new restrictions on edibles?

Cannabis products can no longer be made in the shape of a human being, animal, insect, or fruit. Aside from aesthetics, edibles can now only contain 100mg of THC in each 10-serving package.

  1. How much “Adult-Use” Cannabis will I be able to purchase on Jan. 1?

1oz. of flower, 8g of concentrates, and up to 6 plants

  1. Where can I actually consume marijuana?

Using marijuana in public is still illegal and anyone caught can be fined anywhere from $100 to $250 for smoking in places where tobacco is banned (think: restaurants and offices, in front of certain buildings).

  1. Can I fly or drive with cannabis?

As of November 9, 2016, the fine for driving with an OPEN cannabis “container” is up to $250. After January 1, all cannabis products will be packaged in child resistant bags before exiting the dispensary and should remain concealed while in transportation. Driving under the influence of marijuana is illegal as well as transporting cannabis across state lines. (Sorry tourists, you must smoke your stash before heading home.)

  1. Will police search me if my car smells like marijuana?

Thanks to new regulations police can no longer use the smell of marijuana or the presence of cannabis products as a legal reason to detain or search you, your vehicle, or your place.

  1. Can I buy a water pipe from a dispensary?

Not anymore – After January 1, Businesses that sell alcohol or tobacco cannot sell marijuana, or vice versa.

  1. Where will I be able to find a recreational dispensary?

As of now there are only 7 licensed recreational cannabis retail shops in the city of San Diego (2 of them being Urbn Leaf locations). Recreational cannabis shops cannot be within 600 feet of schools, youth centers and daycare centers. To see the full list of “Adult-Use” licensed stores in California click here:
